Determining whether an insurance company did "the right thing"
in denying coverage, monitoring its agents, dealing with reinsurers,
administering programs or in a number of other areas can be difficult.
It has long been said that insurance underwriting is an art, not
a science. While that is generally true, there is, in fact, considerable
science involved in the art of underwriting. It consists of both
actuarial and other financial analysis and projections. In addition,
there are generally agreed industry practices in each of the underwriting,
claim handling and marketing areas.
During the past fourteen years, I have successfully assisted many attorneys representing insurance companies, insurance agents or policyholders in addressing litigation concerns either as plaintiffs or defendants. I have served as a litigation consultant, expert witness and as an arbitrator in a variety of matters.
It is no secret that successful litigation is usually driven by successful preparation including the all important discovery process. Insurance disputes often turn on the ability of attorneys to probe the right areas in interrogatories and ask the right questions in depositions. These are the areas in which I have been most helpful as an insurance litigation consultant. In addition, my many years of experience in the insurance industry have given me the insight required to successfully serve as an expert witness. Needless to say, service as an arbitrator also requires awareness of the proper avenues of inquiry and industry standards.
My extensive experience in a variety of commercial and professional liability insurance areas has proved particularly valuable in spotting issues and formulating well reasoned opinions in complex insurance litigation matters.
